NOTICE OF PROPOSED MODIFICATION TO THE HAZARDOUS WASTE FACILITY/SUBPART X/SOLID WASTE
MANAGEMENT UNIT (SWMU) CORRECTIVE ACTION PERMIT UNDER THE ALABAMA HAZARDOUS WASTES
MANAGEMENT AND MINIMIZATION ACT (AHWMMA) AND REQUEST FOR COMMENTS

U.S. Army Garrison – Redstone Arsenal (RSA) of Redstone Arsenal, Alabama submitted to ADEM applications for modification of its Hazardous Waste Facility Permit. The permit consists of the Hazardous Waste Storage Facility, Subpart X Open Burning (OB) Unit and Subpart X Open Detonation (OD) Unit and SWMUs/Areas of Concern (AOCs) that are used to manage hazardous waste at its facility (EPA I.D. Number AL7 210 020 742) located in Huntsville, Madison County, Alabama. The Department has determined that the facility’s modification applications are complete and has prepared a draft permit modification in accordance with State regulations.

RSA operates a facility that treats and stores hazardous waste. The hazardous waste treatment and storage facility consists of the following: a hazardous waste storage area (33 storage igloos), OB treatment unit, Subpart X OD treatment unit, SWMUs, and AOCs. RSA is the owner and operator of the facility. This proposed permit modification includes the corrective measures implementation (CMI) planned at SWMUs RSA-014S (Parts I,II,III), RSA-122 and RSA-183 (Parts I,II,III,IV,V,VI,VII,VIII,IX), RSA-271 (Parts I & II), and RSA-306 (Parts I,II,III,IV); these SWMUs have been moved from the table indicating a CMI plan is necessary to the table indicating corrective measures are required. The corrective measures for surface media have been completed for SWMU RSA-255 and RSA-140; consequently, no further action is necessary at this time for RSA-255. SWMUs RSA-028, RSA-238, RSA-291, RSA-304, RSA-319, RSA-320, and RSA-321 were moved from the table indicating an investigation is required to the table indicating a CMI plan is required. New SWMU RSA-071-R-01 has been added to the master list of known SWMUs and the table indicating that an investigation is required. SWMUs RSA-271 and RSA-306 have been added to RSA’s Corrective Action Monitoring Program. Monitoring well RS814 has been replaced by monitoring well RS3054 as a test location for SWMU RSA-083 in the Corrective Action Monitoring Program. The groundwater monitoring requirements for SWMUs RSA-054/RSA-055 and RSA-269 have been modified to sample on an annual and semiannual basis, respectively. The Permit application was updated to reflect the changing status of the aforementioned SWMUs and incorporate SWMU RSA-071-R-01. Furthermore, the proposed modification includes some minor administrative changes. Finally, the proposed permit modification includes provisions that require any other solid waste management units and areas of concern at the facility to be addressed.

Persons wishing to comment may do so, in writing or by email, to the Department's named contact above by 5:00 pm on April 23, 2024. To affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit modification.

A written request for a public hearing may also be filed by 5:00 pm on April 23, 2024 and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the AHWMMA, the federal Resource, Conservation and Recovery Act (RCRA) and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request. Information will be sent to any person requesting notice of the final action.
