PROPOSED CONSENT ORDER

Morgan County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Pace Analytical Services, LLC (EPA Identification Number ALR000067512), which operates a commercial environmental laboratory located at 1313 Point Mallard Parkway SE in Decatur, Morgan County, Alabama.

The violations consisted of the following:  failure to mark satellite accumulation containers of hazardous waste with an indication of the hazards; storage of hazardous waste for greater than 180 days without a permit; failure to conduct or document weekly inspections of hazardous waste accumulation areas; failure to mark containers of hazardous waste with indications of the hazards; failure to mark containers of hazardous waste with accumulation start dates; failure to maintain adequate aisle space; failure to make or document arrangements with local emergency responders; failure to post the location of fire extinguishers, spill control material, and fire alarms; failure to submit a correct and complete ADEM Form 8700-12 to the Department; and failure to provide for review all manifests for the previous three years.

The Department is proposing a civil penalty in the amount of $12,880.  The Order, if issued, would require Pace Analytical Services, LLC to comply with all applicable requirements of Division 14 of the ADEM Administrative Code.
