NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

CHOCTAW COUNTY

Georgia-Pacific Naheola LLC, 7530 Highway 114, Pennington, AL 36916, NPDES Permit Number AL0003301, located at the same address, for reissuance of a permit, which authorizes discharges resulting from treated process wastewater, sanitary wastewater, landfill leachate, and storm water runoff associated with the production of pulp and paper, through DSN001 to the Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin; storm water runoff from non-process areas and storm water from Borrow Pit A, through DSN002 to the Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin; and storm water runoff from non-process areas, through DSN003 to the Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin. At this time, the Department has determined that the cooling water intake structure represents the best technology available (BTA) to minimize adverse environmental impacts in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326).

JACKSON COUNTY

Daikin Applied America, Inc., 13600 Industrial Park Blvd, Plymouth, MN 55441, NPDES Permit Number AL0069701, located at 17601 Hwy 35 E, Scottsboro, AL 35768, for Reissuance of a permit, which authorizes discharges resulting from treated effluent from groundwater remediation, discharging through DSN001 to an Unnamed Tributary to Roseberry Creek, which is classified as Fish and Wildlife, in the Tennessee River Basin.

JEFFERSON COUNTY

WATCO Alabama Port Services, LLC., 8250 Birmingport Road, Mulga, AL 35118, NPDES Permit Number AL0045161, located at the same address, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff from the loading, unloading, and storage of coal, coke, iron ore, and gypsum through Outfalls DSN001 to DSN005 to the Locust Fork of the Black Warrior River, classified as Fish & Wildlife, in the Black Warrior River Basin.

MOBILE COUNTY

Mobile County Commission - Chunchula Sanitary Landfill, 205 Government Street, 6th Floor South, Mobile, AL 36644, NPDES Permit Number AL0062791, located at Chunchula Landfill Road, Chunchula, AL 36521, for reissuance of a permit, which authorizes discharges resulting from treated stormwater and leachate from closed RCRA Subtitle D non-hazardous waste landfill, through DSN001 to an unnamed tributary to Sweetwater Branch, classified as Fish & Wildlife, in the Mobile River Basin.

Radcliff Economy Marine, PO Box 3064, Mobile, AL 36652, NPDES Permit Number AL0073474, located at 145 Cochran Causeway, Mobile, AL 36652, for reissuance of a permit, which authorizes discharges resulting from storm water from petroleum and chemical handling and storage areas and hydrostatic test water, through DSN001 and DSN002 to the Mobile River, classified as Limited Warmwater Fishery, in the Mobile River Basin.

WALKER COUNTY

United Refining Company - Vulcan Asphalt Terminal, PO Box 780, Warren, PA, 16365, NPDES Permit Number AL0025275, located at 4215 River Road, Cordova, AL 35550, for reissuance of a permit, which authorizes discharges resulting from boiler blowdown and storm water drainage from secondary containment at the South Tank Farm through DSN001 to Cane Creek, classified as Limited Warmwater Fishery, in the Black Warrior River Basin; and boiler blowdown and storm water drainage from secondary containment at the North Tank Farm through DSN002 to Cane Creek, classified as Limited Warmwater Fishery, in the Black Warrior River Basin; and stormwater associated with asphalt loading operations through DSN003 to Cane Creek, classified as Limited Warmwater Fishery, in the Black Warrior River Basin; and stormwater associated with asphalt loading operations through DSN004 to Mulberry Fork, classified as Public Water Supply and Fish & Wildlife, in the Black Warrior River Basin.

Vulcan Construction Materials, LLC – Rock Spring Quarry, 1200 Urban Center Drive, Birmingham, Alabama 35242, NPDES Permit Number AL0076996, located on Old US Highway 431, Glencoe, Etowah County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation limestone quarry and associated areas, discharging to Little Cove Creek, classified as Fish and Wildlife, in the Coosa River Basin.

JEFFERSON COUNTY

Drummond Company, Inc. - Short Creek Preparation Plant, PO Box 1549, Jasper, Alabama 35502, NPDES Permit Number AL0043711, located at 2250 Short Creek Road, Mulga, Jefferson County, Alabama, for modification of a permit that limit discharges from a wet and dry cool preparation plant and associated areas, discharging to Locust Fork, an unnamed tributary to Locust Fork, Short Creek, Fishtrap Branch, and an unnamed tributary to Fishtrap Branch, classified as Fish and Wildlife, in the Black Warrior Basin.

SHELBY COUNTY

Argos Cement, LLC – Roberta Plant, PO Box 182, Calera, Alabama 35040, NPDES Permit Number AL0024252, located at 8309 Highway 25, Calera, Shelby County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation limestone quarry, common clay mine, low volume sewage treatment plant, lime and cement production plant, and associated areas, discharging to Dry Creek and an unnamed tributary to Dry Creek, classified as Fish and Wildlife, in the Cahaba River Basin.

TUSCALOOSA COUNTY

S.T. Bunn Construction Co., Inc.-Fosters Borrow Pit, 611 Helen Keller Blvd. Tuscaloosa, Alabama 35404, NPDES Permit Number AL0083283, located at 16203 Lock 9 Road, Fosters, Tuscaloosa County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation construction sand and gravel mine, and associated areas, discharging to unnamed tributaries to the Black Warrior River, classified as Fish and Wildlife, in Black Warrior River Basin.

The subject permit regulates the discharge of treated wastewaterto Blackburn Fork, which is classified as Fish & Wildlife, in the Black Warrior River Basin.

Living Water Utilities, LLC, 5800 Feldspar Way, Suite 200, Birmingham, AL  35244, NPDES Permit Number AL0068675, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Southeastern School Lagoon, 18770 Alabama Highway 75, Remlap, AL  35133, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewaterto Campbell Creek, which is classified as Fish and Wildlife (F&W), in the Black Warrior River Basin.

CALHOUN COUNTY

Calhoun County Board of Education, PO Box 2084, Anniston, AL 36202, NPDES Permit Number AL0043052, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Northern District School Lagoon, 4141 Pleasant Valley Road, Jacksonville, AL 36265, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to UT to Ohatchee Creek, classified as Fish and Wildlife, in the Coosa River Basin.

CRENSHAW COUNTY

Town of Rutledge, PO Box 85, Rutledge, AL 36071, NPDES Permit Number AL0062634, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Rutledge Wastewater Lagoon, Alabama Highway 10 NW1/4 - 26 9N-17E Rutledge, AL  36071, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto the Little Patsaliga Creek, which is classified as Swimming and Fish and Wildlife in the Escambia River Basin.

DALLAS COUNTY

Safetynet Youth Systems LLC, 80 Mel Bailey Drive, Minter, AL 36761, NPDES Permit Number AL0048135, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Safetynet Youth Systems, 80 Mel Bailey Drive, Minter, AL 36761, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto an unnamed tributary to an unnamed tributary to Oak Creek, which is classified as Fish and Wildlife in the Alabama River Basin.

JACKSON COUNTY

Jackson County Health Care Authority, PO Box 1002, Bridgeport, AL 35740, NPDES Permit Number AL0056197, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Cumberland Health and Rehab, 47065 Alabama Hwy 277, Bridgeport, AL 35740, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Widows Creek, classified as Swimming and Fish and Wildlife, in the Tennessee River Basin.

JEFFERSON COUNTY

Jefferson County Housing Authority, 3700 Industrial Parkway, Birmingham, AL  35217, NPDES Permit Number AL0032301, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Dixie Manor Housing Project WWTP, 3995 Sharon Church Road, Pinson, AL  35126, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto a UT to Self Creek, which is classified as Fish & Wildlife, in the Black Warrior.

PICKENS COUNTY

U S Army Corps Of Engineers Tenn-Tom Waterway, 5000 N. Frontage Rd, Columbus, MS  39701, NPDES Permit Number AL0029700, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Cochrane Park, 707 Tenn-Tom Park Road Aliceville, AL  35442, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto the Tombigbee River (Gainesville Lake), which is classified as Swimming, Fish and Wildlife, in the Tombigbee River Basin.

RUSSELL COUNTY

Russell County Board of Education, PO Box 400, Phenix City, AL  36868, NPDES Permit Number AL0057088, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Russell County High School, 4699 Old Seale Highway Seale, AL  36875, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to groundwater in the Chattahoochee River Basin.

 

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period. 

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
