PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Constellium Muscle Shoals LLC, the owner/operator of a secondary aluminum processing facility currently operating in Muscle Shoals, Colbert County, Alabama.

The violations include failure to comply with state opacity standards, failure to maintain capture and control equipment, and failure to accurately certify compliance.

The Department is proposing a civil penalty in the amount of $225,000.  The Order, if issued, would require Constellium Muscle Shoals LLC to pay the Alabama Department of Environmental Management within 45 days of the receipt date of the final Consent Order, and comply with the terms, limitations, and conditions of the Permit and the Department’s regulations according to the schedule outlined in the Consent Order.

The comment period shall end at the close of business 30 days from the publication date of this notice.  A copy of the proposed Order is available on the ADEM web page at http://adem.alabama.gov/compInfo/adminOrders.cnt, or may be obtained by written request to the above address.  A nominal fee for copying may be charged.
