PROPOSED CONSENT ORDER
Colbert County
Pursuant to the provisions of the Alabama Environmental Management Act, Code of Alabama §§ 22-22A-1 through §§ 22-22A-16 (2006 Rplc. Vol.), and the Solid Wastes and Recyclable Materials Management Act (SWRMMA), Ala. Code §§ 22-27-1 to 22-27-18 (2006 Rplc. Vol.) as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to the Solid Waste Disposal Authority for the Cities of Muscle Shoals, Sheffield and Tuscumbia, Alabama which holds the permit for the Cherokee Industrial Landfill, a solid waste disposal facility in Cherokee, Colbert County, Alabama.
The violations listed in the Order consist of: failure to maintain on-site drainage structures, failure to maintain the leachate collection system, failure to operate as stipulated in permit (prevent release/leachate seeps and failure to properly dispose of leachate), failure to properly confine waste/operating multiple disposal areas, failure to control litter, failure to cover waste weekly/monthly, and failure to comply with Order No. 21-088-SW.
The Department is proposing a civil penalty in the amount of $200,000.00. The Order, if issued, would require the facility to correct all violations above within the prescribed timeframes, and to operate in compliance with ADEM Admin. Code 335-13 in the future.

The comment period shall end at the close of business 30 days from the publication date of this notice. A nominal fee for copying may be charged.
This notice is hereby given this 6th day of May, 2022, by authorization of the Alabama Department of Environmental Management.
