PROPOSED ADMINISTRATIVE ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§ 22-22A-1 to 22-22A-17, as amended; the Alabama Water Pollution Control Act (AWPCA), Ala. Code §§ 22-22-1 to 22-22-14, as amended; and the ADEM Administrative Code of Regulations, the Alabama Department of Environmental Management is proposing to issue an Administrative Order to Alabama Power Company, which owns and operates the Plant Gadsden Ash Pond, a Facility in Gadsden, Etowah County, Alabama.

The violations listed in the Order consist of unpermitted discharge of fluids and/or pollutants to groundwater and/or soils.

The Department is proposing a civil penalty in the amount of $250,000.00. The Order, if issued, would require the owner to submit to the Department a plan with a schedule for implementation of a comprehensive groundwater investigation, an Assessment of Corrective Measures, an Investigative Report evaluating any deficiencies at the Facility that may have led to the unpermitted discharge and quarterly progress reports.

Interested persons may submit written comments, including a request for a hearing, within 30 days of the publication date of this notice to:
