PROPOSED CONSENT ORDER

Madison County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management (ADEM) is proposing to issue an Order to J. C. Development Company – Lyons Road Subdivision also known as Quail Run, at the intersection of Lyons Road and Ed Spears Road, in the City of Owens Cross Roads, Madison County, Alabama.
                                                      
The violations consisted of: Effective BMPs had not been implemented and/or maintained; Discharge from dewatering activities offsite without appropriate controls to minimize uncontrolled discharges of turbidity/solids; Noncompliance with the requirements of ADEM NPDES construction stormwater rules.

The order, if issued, would require the operator to: correct all violations; implement and maintain effective BMPs; pay a civil penalty in the amount of $9,000.

Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to:

This notice is hereby given this 22nd day of April, 2022, by authorization of the Alabama Department of Environmental Management.
