NOTICE OF APPLICATION AND PUBLIC HEARING FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

 

MOBILE COUNTY

The City of Bayou La Batre WWTP, 13321 North Wintzell Ave., Bayou La Batre, Alabama, 36509, NPDES Permit Number AL0078921, located at Railroad Avenue, Bayou La Batre, Alabama has applied for initial issuance of discharge DSN001 consisting of treated sanitary and seafood processing wastewaters discharging to Portersville Bay of Mississippi Sound, and discharge DSN002 consisting of stormwater discharging to Portersville Bay of Mississippi Sound.

In this regard, notice is hereby given that a public hearing before the Department of Environmental Management of the State of Alabama will be held on June 24, 2008 starting at 6:00 P.M. in the Bayou La Batre Community Center, 12745 Padgett Switch Road, Irvington, Alabama.

The Department has tentatively determined that the proposed action described in this notice is consistent with the Water Quality Program regulations, and the Alabama Coastal Management Program.

Copies of the draft permit, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via www.adem.alabama.gov/PublicNotice/PublicNotice.htm, and at the following locations Monday - Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact below prior to 5:00 PM, June 25, 2008. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

After consideration of all written comments, review of the public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the Federal Water Pollution Control Act and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request. Notice will be sent to any person requesting notice of the final action.
