NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT, PUBLIC HEARING, AND REQUEST FOR COMMENTS

Chemical Lime Company of Alabama, LLC, 2885 Highway 31 South, Calera, AL 35040 has submitted a water permit application for a proposed limestone quarry at 2885 Highway 31 South in Calera, Alabama. Notice is also given that ADEM will hold a public hearing on April 30, 2009, at 6:30 PM, at Calera City Hall, 10947 Highway 25, Calera, Alabama, concerning the application for the water discharge permit.
Chemical Lime Company of Alabama, LLC has applied for issuance of a National Pollutant Discharge Elimination System (NPDES) Permit, proposed NPDES Permit Number AL0079308, for proposed discharges of treated drainage from a crushed stone mine and associated areas to an unnamed tributary to Buxahatchee Creek, and Buxahatchee Creek, both classified for Fish & Wildlife in the Coosa River Basin; and an unnamed tributary to Dry Creek, classified for Fish & Wildlife in the Cahaba River Basin. The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Rules including the Department’s Anti-degradation Rules.
Copies of the draft permit, conditions, and limitations as applicable are available for public inspection electronically via http://www.adem.state.al.us/PublicNotice.htm, and at the following location(s) Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and / or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department’s named contact above. In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.
The purpose of the public hearing will be for interested parties to make oral and written comments part of the official hearing record. Those wishing to make oral comments at the public hearing are encouraged to submit those comments in writing.
All comments must be submitted to the Department by 5:00 pm on May 1, 2009. Also, oral comments and technical data can be submitted during the public hearing on April 30, 2009.
Any person wishing to participate in this public hearing who needs special accommodations should contact ADEM Permits and Services Division at (334) 271-7714 at least three working days prior to the public hearing.
Attendance at the public hearing is not necessary in order to have comments included in the official administrative record. Written comments received prior to the close of the public comment period will also be considered and entered into the administrative record.
After consideration of all written comments, review of the public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the Federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments which will become part of the public record and will be available to persons upon request. Notice will be sent to any person requesting notice of the final action.
