Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-16 (2006 Rplc. Vol.), the Alabama Department of Environmental Management is proposing to issue a Consent Order to Mathews Petroleum Supply, Inc., owner/operator of a Gasoline Tank Truck currently operating in Andalusia, Alabama.

The violation consisted of Mathews Petroleum Supply, Inc. failing to process gasoline vapors through a vapor control system during transfer of gasoline from a gasoline tank truck into a gasoline storage tank.

The Department is proposing a civil penalty in the amount of $4,800.00. The order, if issued, would require Mathews Petroleum Supply, Inc., to immediately upon the effective date of this Consent Order and continuously each and every day thereafter, comply with all provisions and regulations detailed in Air Permit 603-T004-X003, ADEM Administrative Code R. 335-3-6-.07 and all other applicable air pollution control rules and regulations at all facilities at all times.
