PROPOSED ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to the Town of Brilliant, which operates a facility located on Bostick Street, in Brilliant, Marion County, Alabama.
The Order addresses NPDES permit violations for discharge limitation violations, failure to submit noncompliance notifications, failure to monitor as required by the Permit, failure to submit required Discharge Monitoring Reports, failure to reapply, and discharging without a permit.
The Department is proposing a civil penalty in the amount of $7,000 and stipulated penalties for failure to meet milestone dates. The order, if issued, would require the Town of Brilliant to submit an engineering report and to implement the corrective actions needed to comply with all provisions of NPDES Permit Number AL0057169 within 365 days of the effective date of the Consent Order.
Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention James E. McIndoe, Chief of the Water Division, P.O. Box 30l463, Montgomery, Alabama 36l30-l463. The comment period shall end at the close of business 30 days from the publication date of this notice.
