NOTICE OF REQUEST FOR COMMENTS AND ANNOUNCEMENT OF PUBLIC HEARING ON: THE PROPOSED MODIFICATION OF THE HAZARDOUS WASTE FACILITY PERMIT FOR THE UNITED STATES DEPARTMENT OF THE ARMY, ANNISTON ARMY DEPOT; THE UNITED STATES DEPARTMENT OF THE ARMY, ANNISTON CHEMICAL AGENT DISPOSAL FACILITY FIELD OFFICE; AND WASHINGTON GOVERNMENTAL ENVIRONMENTAL SERVICES COMPANY LLC, UNDER THE ALABAMA HAZARDOUS WASTES MANAGEMENT AND MINIMIZATION ACT (AHWMMA).
The U.S. Department of the Army, Anniston Chemical Agent Disposal Facility Field Office, has requested to modify the Hazardous Waste Facility Permit issued to the U.S. Department of the Army, Anniston Army Depot; U.S. Department of the Army, Anniston Chemical Agent Disposal Facility Field Office; and Washington Governmental Environmental Services Company LLC. The EPA Identification Number for the site is AL3 210 020 027. The proposed major permit modification pertains to the following:
Replacement of the existing Deactivation Furnace System (DFS) Heated Discharge Conveyor with a wire mesh conveyor including removal of the heat requirement for mustard operations.
Permitting a new tank system for treatment of hazardous waste brine generated by the Pollution Abatement System (PAS).
Installation of a Linear Projectile and Mortar Disassembly (LPMD) Facility at Building 695 of the ANAD Chemical Limited Area (CLA) for the purpose of conducting a mustard projectile baseline study in support of the Assembled Chemical Weapons Assessment (ACWA) program.
Updating the professional engineer certification requirements to meet recent changes in State and Federal regulations.
The Anniston Army Depot (ANAD) is located approximately 10 miles west of the City of Anniston, AL on State Highway 202. The small community of Bynum is located on ANAD's southern boundary. The northern boundary is Pelham Range, a wooded military munitions operational and training area that is currently owned by the U.S. Army. Lightly populated rural lands border the eastern and western boundaries. The U.S. Army has constructed the ANCDF to destroy the unitary chemical weapons and agents stored at ANAD in accordance with 50 U.S.C. 1521 that mandates the destruction of 45% of stockpiled chemical weapons by December 31, 2007. The AHWMMA Hazardous Waste Permit was first issued to the Permittees on June 19, 1997 with subsequent renewal of the permit on November 14, 2007.
Copies of the fact sheet, existing permit, proposed permit modification, preliminary determination and permit application are available for public inspection electronically via http://www.adem.state.al.us/PublicNotice/PublicNotice.htm, and at the following locations Monday through Friday, except legal holidays, during normal working hours. A nominal fee for copying and/or mailing will be charged. Arrangements for copying should be made in advance by contacting ADEM’s Records Manager at the Montgomery address.

Persons wishing to comment on the proposed permit modification may do so, in writing, to the Alabama Department of Environmental Management, ATTENTION: Russell A. Kelly, Chief, Permits & Services Division, Post Office Box 301463, Montgomery, Alabama 36130-1463. Comments must be received by 5:00 p.m. on September 5, 2008. In order to affect final decisions, all comments must address issues that have an impact on the applicant’s ability to comply with applicable environmental laws, rules and regulations.
A formal Public Hearing will be held on August 19, 2008, beginning at 7:00 p.m. The Public Hearing will be held at the following location:

The purpose of the hearing will be to provide interested parties the opportunity to make oral comments that may be officially entered into the Administrative Record. Those persons wishing to make comments at the hearing are also encouraged to submit their comments in writing. The public comment (i.e., review and comment) period will remain open following the date of the hearing until 5:00 p.m. on September 5, 2008.
All comments received during the 47-day public comment period or at the public hearing will be considered by the Department in making its final determination regarding the proposed permit modification. After consideration of all formal comments and the requirements and policies of the AHWMMA, the Department will make its final decision regarding the proposed permit renewal application. When the Department makes its final decision, notice will be given to the applicant and to each person who has submitted written comments or requested notice of the final decision. If the draft permit is substantially changed, the Department will issue a public notice indicating the changes prior to issuing its final decision.
The Alabama Department of Environmental Management maintains a list of interested individuals who are mailed legal notices regarding proposed permits and major permit modifications. Likewise, anyone wishing to be notified of final decisions for permit issuance must request so in writing.
