The Alabama Department of Environmental Management proposes to amend the Alabama State Plan to incorporate amendments to the Emission Guidelines for Existing MWCs as promulgated May 10, 2006 (71 FR 27324).

On December 19, 1995, the USEPA promulgated New Source Performance Standards (NSPS) for Municipal Waste Combustors (MWCs) and Emission Guidelines for Existing MWCs. The Emission Guidelines (EG) implement §111(d) of the Clean Air Act (the Act). The EG require a State to submit a plan that establishes emission standards for existing sources when NSPS have been promulgated. An existing MWC is a MWC for which construction commenced on or before September 20, 1994. The Department submitted a State Plan in September 1998. The plan was approved on November 18, 1998 (63 FR 63988).

The Department’s plan incorporates the EG requirements into the Air Permits for the Huntsville Solid Waste Authority’s (HSWA) Municipal Waste combustors. The plan demonstrates the Department’s determination of the regulated universe, as well as the legal authority for implementing this plan. No emissions from the source will be allowed to increase due to this action.
