NOTICE OF A PROPOSED MAJOR MODIFICATION OF A PERMIT UNDER THE ALABAMA HAZARDOUS WASTES MANAGEMENT AND MINIMIZATION ACT (AHWMMA) FOR CIBA CHEMICALS CORPORATION FOR IT’S FACILITY IN McINTOSH, ALABAMA.

Ciba Chemicals Corporation, (Ciba) has submitted an application to the Alabama Department of Environmental Management (ADEM) for it’s facility located at 1379 Ciba Road, McIntosh, Alabama, EPA I.D. Number ALD 001 221 902 to modify its AHWMMA permit for a hazardous waste incinerator, an aboveground landvault, a tank storage, and several closed RCRA units which were used to manage hazardous waste.

 

Copies of the fact sheet and draft AHWMMA permit modification package are available for public inspection Monday through Friday, except legal holidays, during normal working hours at the following locations:

Copies may be obtained by contacting Mr. Russell Kelly of ADEM, at the Montgomery address.  A nominal fee for copying and/or mailing will be charged.  Arrangements for copying should be made in advance.

 

ADEM is limited in the scope of its analysis to environmental impacts.  Therefore, any comments relative to zoning or economic and social impacts are within the purview of local zoning and planning authorities and should be expressed to them.  To have any impact on the final permitting decision comments must address issues which have an impact on the applicant's ability to meet environmental laws, rules, and regulations.  Furthermore, only the modified portions of the subject permit are open to comment. 

 

Any interested persons wishing to comment on the proposed AHWMMA permit modification should submit such comments in writing to the Alabama Department of Environmental Management, ATTENTION: Mr. Russell Kelly, at the Montgomery address.  Comments must be received by 5:00 p.m. on March 24, 2008.

If significant interest is expressed, a public hearing will be scheduled.  A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised at the hearing.  Any request for a public hearing must be received by 5:00 p.m. on March 24, 2008.

 

All relevant comments received during the public comment period or at the public hearing will be considered in the formulation of a final determination regarding the permit modification.  After consideration of all formal comments and the requirements and policies of the AHWMMA, the Department will make its final decision regarding the permit modification.  When the Department makes its final decision, notice will be given to the applicant and each person who has submitted written comments or requested notice of the final permit modification decision.  If the draft permit modification is substantially changed, the Department will issue a public notice indicating the revised conditions prior to its final decision.

 

The Alabama Department of Environmental Management maintains a list of interested individuals who are mailed legal notices regarding proposed AHWMMA permits.  If you wish to receive such notices, contact Mr. Russell A. Kelly, at the Montgomery address.  Likewise, anyone wishing to be notified of the final decision must request such in writing.
