NOTICE OF PUBLIC HEARING

FOR PROPOSED REVISIONS TO THE

ALABAMA STATE IMPLEMENTATION PLAN (SIP)

 

            Notice is hereby given that the Alabama Department of Environmental Management of the State of Alabama is providing the opportunity for interested persons to request a public hearing and comment on proposed revisions to the Alabama State Implementation Plan (SIP).

 

If the Department receives a request for a hearing, the hearing will be held on January 23, 2008, at 10:00 a.m. in the Main Hearing Room at the ADEM – Central Office location at 1400 Coliseum Blvd. in Montgomery.

 

Those requesting a hearing must call (334) 394-4360.  The deadline to submit a request for a hearing is 5:00 p.m. on January 8, 2008.  If no requests for a hearing are received prior to this date, a Notice of Cancellation of the hearing will be posted on January 9, 2008, on the Department's website at www.adem.alabama.gov/PubHearings/PubHearings.htm.  Interested persons may also call (334) 270-5634 to determine if the public hearing has been cancelled.

 

            The Alabama Department of Environmental Management proposes to amend the Alabama State Implementation Plan to adopt contingency measures for the maintenance of the 8-hour ozone NAAQS.

 

On May 12, 2006, EPA approved the 8-hour ozone redesignation request submitted by the State of Alabama which changed the legal designation of the Birmingham area from nonattainment to attainment for the 8-hour ozone NAAQS.  This rule also approved ADEM's 8-hour ozone maintenance plan for Jefferson and Shelby Counties.  After attaining the 8-hour ozone NAAQS during 2003-2005, the area violated the NAAQS during 2004-2006.  In the maintenance plan approved by EPA, Alabama committed to adopt within 18 months of a violation of the 8-hour ozone standard, one or more control measure(s) (contingency measures) to re-attain the standard.  ADEM has evaluated ozone precursor (NOx) emissions in the area and has identified NOx controls that will be installed on two cement plants in the Birmingham area.

If requested, a hearing will be held to receive data, views, and arguments from interested persons regarding the proposed revisions.  Attendance at the hearing is not necessary to present such data, views, arguments, or comments as the same may be submitted in writing, but must be received by the Hearing Officer prior to 5:00 p.m. on January 25, 2008.
