NOTICE OF REQUEST FOR COMMENTS AND ANNOUNCEMENT OF PUBLIC HEARING FOR MODIFICATION OF THE OPERATING PERMIT UNDER THE ALABAMA HAZARDOUS WASTES MANAGEMENT AND MINIMIZATION ACT (AHWMMA)
CALHOUN COUNTY
The U.S. Department of the Army, Anniston Army Depot, of Anniston, Alabama (EPA I.D. Number AL3 210 020 027) submitted to ADEM an application for modification of its operating permit for addition of two permitted units for thermal treatment – one open burning unit and one open detonation unit. These units have operated prior to this action under the Interim Status provisions of the AHWMMA and associated regulations. The Department has determined the facility’s modification application to be complete and has prepared a draft permit in accordance with State regulations.
The Anniston Army Depot (ANAD) is located approximately 10 miles west of the City of Anniston, AL on State Highway 202. The small community of Bynum is located on ANAD's southern boundary. The northern boundary is Pelham Range, a wooded military munitions operational and training area that is currently owned by the U.S. Army. Lightly populated rural lands border the eastern and western boundaries. The AHWMMA Hazardous Waste Permit was first issued on June 19, 1997 with subsequent renewal of the permit on November 14, 2007.

Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department’s named contact above within 45 days following the publication date of this notice. In order to affect final decisions, all comments must offer technically substantial information that is applicable to the proposed permit.
A formal Public Hearing will be held on September 3, 2009, beginning at 7:00 p.m., at the following location:

The purpose of the hearing will be to provide interested parties the opportunity to make oral comments that may be officially entered into the Administrative Record. Those persons wishing to make comments at the hearing are also encouraged to submit their comments in writing. The public comment period will remain open following the date of the hearing until 5:00 p.m. on September 17, 2009.
After consideration of all written comments, review of the public hearing record, and consideration of the requirements of the AHWMMA, the Federal Resource, Conservation and Recovery Act (RCRA) and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request. Notice will be sent to any person requesting notice of the final action.
