PROPOSED ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to the Town of Carrollton which operates a wastewater treatment facility located on Latham Street in Carrollton, Pickens County, Alabama.

The Order addresses NPDES permit violations for exceeding the discharge limits established in the Permit; for failure to comply with monitoring and reporting requirements imposed by the NPDES permit; for the unpermitted discharge of chlorine; and for other unpermitted discharges to a water of the state.

The Department is proposing a civil penalty in the amount of $7,400 and stipulated penalties for future violations incurred during the compliance schedule. The order, if issued, would require the Town of Carrollton to submit an Engineering Report outlining the corrective actions needed to comply with all provisions of NPDES Permit Number AL0020907 and to adhere to a Compliance Plan that will be submitted to the Department within 180 days from the effective date of the Order. The Compliance Plan is subject to approval by the Department. The Order imposes a requirement to comply with Permit Number AL0020907 no later than 990 days from the effective date of the Order.

Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention James E. McIndoe, Chief of the Water Division, P.O. Box 30l463, Montgomery, Alabama 36l30-l463. The comment period shall end at the close of business 30 days from the publication date of this notice.
