PROPOSED CONSENT ORDER
Pursuant
to the provisions of the Alabama Environmental Management Act, Ala. Code
§§22-22A-1 to 22-22A-16 (2006 Rplc. Vol. and 2007
Cum. Supp.), the Alabama Department of Environmental Management is proposing to
issue a Consent Order to Hi-Ridge
Transport, Inc., which operates a gasoline transport facility located in Highland
Home, Alabama.
The
violation consisted of Hi-Ridge Transport, Inc. failing to process gasoline
vapors through a vapor control system during transfer of gasoline from a
gasoline tank truck into a gasoline storage tank.
The
Department is proposing a civil penalty in the amount of $3,500.00. The Order, if issued, would require the
facility to pay a monetary penalty and comply with all requirements of ADEM Admin. Code R. 335-3-6-.07 and Jefferson
County Department of Health, Air Permit No. 4-07-4184-0011, immediately upon
the effective date of this Order and continuing each and every day thereafter.
