PROPOSED ORDER
Pursuant
to the provisions of the Alabama Environmental Management Act, the Alabama Department
of Environmental Management is proposing to issue an Order to the Enviro Management Corporation, which operates a
wastewater treatment facility known as the Harbortown Townhomes Wastewater Treatment
Facility located on
The
Order addresses NPDES permit violations for exceeding the discharge limits
established in the Permit.
The Department is proposing a civil penalty in the
amount of $18,600 and stipulated penalties for future violations incurred
during the compliance schedule. The
order, if issued, would require Enviro Management Corporation to submit an Engineering Report outlining the corrective
action needed to comply with all provisions of NPDES Permit Number AL0052281
and to adhere to a Compliance Plan that will be submitted to the Department
within 90 days from the effective date of the Order. The Compliance Plan is subject to approval by
the Department. The Order imposes a
requirement to comply with Permit Number AL0052281 no later than 365 days from
the effective date of the Order.
