PROPOSED CONSENT ORDER

ELMORE AND MONTGOMERY COUNTIES

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-16 (2006 Rplc. Vol.), the Alabama Department of Environmental Management is proposing to issue a Consent Order to Couch Ready Mix USA, LLC, owner/operator of Portable Concrete Batch Plants currently operating in Montgomery and Tallassee, Alabama.

The violations consisted of failing to properly maintain and operate all air pollution control devices, resulting in excess emissions from the cement silos.

The Department is proposing a civil penalty in the amount of $15,000.00. The order, if issued, would require Couch Ready Mix USA, LLC, to immediately upon the effective date of this Consent Order and continuously each and every day thereafter, comply with all regulations detailed in ADEM Admin. Code r. 335-3-4-.01 (1)(a)., and all other applicable air pollution control rules and regulations at all facilities at all times.

Interested persons may submit written comments, including requests for a hearing, within 30 days of the publication date of this notice, to:

The comment period shall end at the close of business 30 days from the publication date of this notice. A copy of the proposed order is available on the ADEM web page at adem.alabama.gov or may be obtained by written request to the above address. A nominal fee for copying may be charged.
