ALABAMA DEPARTMENT OF ENVIRONMENTAL MANAGEMENT

 

NOTICE OF PROPOSED ISSUANCE OF A CONSENT ORDER UNDER THE ALABAMA ENVIRONMENTAL MANAGEMENT ACT AND REQUEST FOR COMMENTS

 

SUMTER COUNTY

 

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-16 (2006 Rplc. Vol.), the Alabama Department of Environmental Management is proposing to issue a Consent Order to Chemical Waste Management, Inc. (CWM or the Operator) (EPA Identification No. ALD000622464), the owner and/or operator of a commercial hazardous waste land disposal facility in Emelle, Alabama, that receives both in-state and out-of-state wastes.

 

The violations listed in the Order consist of failure to maintain impervious coatings on secondary containment structures, failure to reflect needed repairs on inspection logs, failure to notify ADEM of modifications to a permitted structure, failure to follow the requirements of the Waste Analysis Plan, failure to reject nonconforming wastes back to the generator within the allotted time, and failure properly mark pumps and related equipment.

 

The Department is proposing a civil penalty in the amount of $65,000.00.  The Order, if issued, would require CWM to comply with the terms, limitations, and conditions of each Permit and Department regulations immediately upon the effective date of the Administrative Order.

The comment period shall end at the close of business 30 days from the publication date of this notice.  A copy of the proposed order is available on the ADEM web page at adem.alabama.gov or may be obtained by written request to the above address.  A nominal fee for copying may be charged.
