PROPOSED ORDER

 

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to the Town of Akron which operates a wastewater treatment facility located on Oak Village Road in Akron, Hale County, Alabama.

The Order addresses NPDES permit violations for exceeding the discharge limits established in the Permit.

The Department is proposing a civil penalty in the amount of $1,500 and stipulated penalties for future violations incurred during the compliance schedule. The order, if issued, would require the Town of Akron to submit an Engineering Report outlining the corrective actions needed to comply with all provisions of NPDES Permit Number AL0059714 and to adhere to a Compliance Plan that will be submitted to the Department within 90 days from the effective date of the Order. The Compliance Plan is subject to approval by the Department. The Order imposes a requirement to comply with Permit Number AL0059714 no later than 730 days from the effective date of the Order.

Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention James E. McIndoe, Chief of the Water Division, P.O. Box 30l463, Montgomery, Alabama 36l30-l463. The comment period shall end at the close of business 30 days from the publication date of this notice. A copy of the proposed order is available on the ADEM web page at www.adem.state.al.us/ or may be obtained by written request to the above address. A nominal fee for copying may be charged.
