Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-16 (2006 Rplc. Vol.), the Alabama Department of Environmental Management is proposing to issue a Consent Order to Alabama Biodiesel Corporation the owner/operator of a biodiesel manufacturing facility currently operating in Moundville, Alabama.

The violations consisted of increasing the production capacity of the facility without applying for a permit and failing to implement a leak detection and repair program.

The Department is proposing a civil penalty in the amount of $18,000. The order, if issued, would require Alabama Biodiesel Corporation to take the necessary actions to comply with all applicable regulations, including permitting requirements, and to comply with the applicable monitoring, reporting, and recordkeeping requirements of 40 CFR Part 60, Subpart VV.
