PUBLIC HEARING NOTICE

 

NOTICE OF APPLICATION AND PUBLIC HEARING FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA

 

The following applicant has applied for initial issuance of an NPDES permit to discharge treated wastewater from the Killen Wastewater Treatment Facility.  In this regard, notice is hereby provided that a public hearing before the Department of Environmental Management will be held on March 25, 2008 beginning at 6:00 p.m. at the Brooks High School Gymnasium located at 4300 Highway 72, in Killen, Alabama.

 

LAUDERDALE COUNTY

 

Alabama Utility Services, LLC, 1405 Dozer, P.O. Box 43388, Birmingham, AL 35243, has applied for initial issuance of an NPDES permit for discharge of treated sanitary wastewater into Mill Creek from an outfall to be known as DSN0011.  The proposed facility is to be known as the Killen Wastewater Treatment Facility, located near the intersection of County Road 50 with County Road 33, in Killen, AL.  The proposed NPDES permit is NPDES Permit Number AL0073539.

 

The Department has tentatively determined that the proposed action described in this notice is consistent with its Water Quality Rules and Regulations and that it is also consistent with the Department's Anti-degradation Rules.

 

A copy of the current draft permit (presenting the permit conditions and limitations), a fact sheet describing the permitting methodology, and other applicable NPDES forms and related documents may be reviewed prior to the hearing at the locations indicated below.  This information may also be obtained by writing the Department at the Montgomery address below or by calling (334) 271-7700 during regular work hours.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.  Then information is  also available on the Internet at: adem.alabama.gov.

In addition, persons wishing to comment may present written and/or oral comments at the subject public hearing.  Any person wishing to participate in this hearing who needs special accommodations should contact the ADEM Permits and Services Division at (334) 271-7714 at least three working days prior to the hearing.

 

COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, all comments must address issues that have an impact on the applicant's ability to comply with environmental law and the Department’s rules and regulations.

 

After consideration of all written comments, review of the public hearing record, and consideration of the requirements and policies of the Alabama Water Pollution Control Act, the Federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination regarding permit issuance, discharge limitations, schedules of compliance, and other conditions. The Department also will develop responses to public comments, which will become part of the public record and which will be available to persons upon request.

 

Notice will be sent to any person who requests notice of the final permit decision.  The Department maintains a list of interested individuals who are mailed legal notices regarding proposed permits.
