NOTICE OF JOINT PUBLIC HEARING

FOR PROPOSED REVISIONS TO DIVISIONS 1 AND 2

ADEM ADMINISTRATIVE CODE

          Notice is hereby given that a hearing before the Department of Environmental Management of the State of Alabama will be held on February 4, 2009, at 1:00 pm in the Main Hearing Room at the ADEM – Central Office location at 1400 Coliseum Blvd. in Montgomery, for the purpose of amending ADEM Administrative Code rule 335-1-1-.03 by adding paragraphs (4), (5), and (6) to establish a process for updating the Unified Strategic Plan (USP), the plan under which the Commission and Department will operate, and ADEM Administrative Code rule 335-2-2-.05 to add a new paragraph, paragraph (h), to include consideration of the relevance and relation of a proposed rule to the most recent USP as an item that the Commission may take into account when it considers petitions for rulemaking. The current paragraph (h) in rule 335-2-2-.05 will be changed to paragraph (i).

          The public hearing is being held to receive data, views, and arguments from interested persons regarding the proposed rules. Attendance at the hearing is not necessary to present such data, views, arguments, or comments as the same may be submitted in writing, but must be received by the Hearing Officer prior to 5:00 pm on February 4, 2009.
