Alabama implements nonpoint source pollution management strategies as described in the State's NPS Management Program. This NPS grant program, often referred to as the Section 319 program, is an integral part of ADEM’s NPS pollution management strategy. These grants are offered to public and private entities for projects that relate to implementation of nonpoint source pollution prevention or reduction. Federal funds can pay up to 60% of eligible project costs while the remaining 40% non-federal match is the responsibility of the applicant. Eligible activities for projects may include:
 

  •  Projects of State-wide Importance
  •  Assessment
  •  Education/Information Programs
  •  Training
  •  Technical Assistance /  Planning
  •  Groundwater Protection
  •  Best Management Practices (BMP)
  •  Watershed Projects/Watershed Resource Restoration
  •  Implementation of Local Regulatory Programs
  •  Development and/or Implementation of Total Maximum
     Daily Loads (TMDLs)

Section 319 funds may not be used to implement specific requirements of draft or final NPDES storm water permits, nor to implement permit requirements of EPA's storm water regulations. Funds may not be used to pay for  "end of pipe" treatments/BMPs which are required as part of a draft or final NPDES permit.

Section 319 “incremental” or watershed-based proposals should primarily target implementation of TMDLs for waterbodies included on Alabama’s Section 303(d) List of Impaired Waters.  These proposals should only address the nonpoint source TMDL causes and sources as listed on the Section 303(d) lists or found in the approved TMDLs.  As a condition of the ADEM review process, proposals must be designed to implement, in whole or part, a watershed-based plan that addresses, to the extent practical, EPA’s nine elements of a “good” watershed-based plan as presented in Supplemental Guidelines for the Award of Section 319 Nonpoint Source Grants to States and Territories in FY 2003.

A checklist is available to assist applicants with meeting the nine watershed-based plan elements.  The checklist must also be submitted to ADEM in conjunction with the Section 319 proposal and watershed-based plan.  Applicants are strongly encouraged to coordinate their proposal at an early stage with the ADEM NPS Unit in order to assure that the proposal will be compatible with Section 319 guidelines and with ADEM TMDL and watershed plan development and implementation goals.
